Hereby, the company “Pistamed Internacional, SL”, with CIF B-42696583 and adress at Plaza Gabriel Miró, 4, 03001 Alicante, as owner of the website www.pistamed.com, exposes its Users the terms and conditions of the service, so that they freely and voluntarily determine if they wish to formalize the purchase of products to be marketed on this web portal, and provide Pistamed with the personal data that is required for this purpose.
The following terms and conditions of sale apply to the offer and sale of products through the website www.pistamed.com (hereinafter, the WEBSITE).
In order to buy on this Website, the following are established as indispensable requirements:
- Clients must be at least 18 years old or, in the case of minors, be duly authorized by their legal guardian;
- Hold the status of consumer, understanding as such a natural person who acts for purposes beyond their industry, trade, business and profession;
- Register on the Website;
- Have a valid credit or debit card.
The contract of sale will be formalized in Spanish and will be regulated by Spanish legislation, with Law 3/2014 of March 27 being applicable, which modifies the Consolidated Text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16 (hereinafter, LGDCU) as well as by Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI).
The Website acts as an intermediary between Users who demand a product purchase service directly requesting the purchase through the Website, in accordance with these Terms and Conditions of Service, which are accessed through the website www.pistamed.com, in the [Terms and Conditions] tab. The Website will collect the personal data provided voluntarily by the Users through its forms, data that will be shared with the seller and, where appropriate, with the other parties involved in the purchase and shipping process, to the extent that It is necessary to comply with the eventual sales that are formalized.
Products and prices
The Website makes available to the User all the information corresponding to the products being sold, in accordance with the provisions of article 60 and concordant of the LGDCU and articles 27 and 28 of the LSSI. The products described and offered on the Website are for the sole personal use of the buyer, who may not sell them to third parties. Pistamed reserves the right, with or without notification, to cancel or reduce the quantity of products being delivered when this implies a breach of these Terms and Conditions.
All prices indicated for the products that are available through the Website are expressed in Euros (€) and include the corresponding percentage of VAT at the rate in force at the time of the formalization of the contract. Shipping costs will be added to the price of the products and are indicated separately in the order form.
Orders placed with shipping and billing address to the Canary Islands will not include VAT in the price of the products or shipping.
Shipment of the order
Orders will be sent every morning from Monday to Friday at 10:30 a.m. Orders placed until the day before 6:00 p.m. will be sent every day. Transit time will depend on the destination of the shipment. We reserve the right to delay the delivery at any time, informing the customer or not, always with the aim of offering a better service and sending all the products of the order in a single shipment.
The orders will be sent by the current shipping company selected by the customer in the order form and the conditions of this will be summarized, coinciding with those set forth in the terms and conditions, along with the shipping option.
In the case of shipments to the Canary Islands, and in order to provide a better service to our customers, we reserve the right to send the order with the shipping company that offers the best services to our client.
Once the product leaves our warehouse, we will send the customer an email confirming that the order has been sent and we will provide the shipping details that are available to us at that time so that they can track it. The sending of these details is subject to the services of the current shipping company.
Any shipping or receiving date provided by us is an estimate and may vary.
In case there is no stock of any product, the shipment with all the products of the order will be made when the order can be completed. Whenever this happens, the customer will know before placing the order with a notice that you will find in the informationof the product provided through the Website.
In the event that extraordinary expenses, customs procedures, customs agents or additional taxes (such as IGIC or AIEM) are derived when sending an order to the Canary Islands, Ceuta, Melilla or Andorra, the seller will not be responsible for any of these expenses or taxes, the client must pay them upon receiving them at his address. No returns or refunds will be accepted for non-payment of said expenses or taxes. In the case of not being paid to the courier, and the client expresses his will not to receive the order either by email or through the courier company, a refund will not be made for the amount of the order to cover the expenses derived from said non-payment or the remaining part will be reimbursed for unpaid expenses and taxes.
Shipping costs will be borne by the customer and are indicated separately in the order form and on the delivery note. These include the preparation of the shipment, the transport, the insurance, the tracking by the transport company and, finally, the delivery. They do not include taxes or tariffs.
Orders will be delivered exclusively on business days (Monday through Friday excluding holidays). Deliveries will always be made at the address chosen by the customer, without prejudice to a voluntary change of address that may involve the increase in the amount of the shipment, whose total cost will be paid by the customer, who must pay it in cash at the time of Receipt of the order.
In case of not being at your address, the package will be delivered to a third person who can be held responsible (concierge, doorman, receptionist, etc.), provided that this third person accepts it, taking responsibility for the merchandise.
If delivery is impossible, we will work with the client and the transport company to choose a date and a time when delivery of the shipment is possible.
In accordance with the provisions of article 109 of the LGDCU, the products will be delivered within 30 (thirty) days after the order is placed by the customer, except in the case of products out of stock and the Customer has been previously notified, as well as in the case of temporary non-availability of the product.
The non-acceptance of the order at the time of delivery by the customer implies extraordinary expenses of ten euros (€ 10.00 -) that will be subtracted from the total amount to be reimbursed in case the refund is requested by the client. In the event that the delivery is not made effective within the deadline agreed with the partner transport company, the customer must directly claim the transport company, refusing Pistamed from any responsibility in this regard.
The customer can contact the seller by sending an email to firstname.lastname@example.org, either in order to request assistance or if you want to check the status of an order.
With a client account created on the Website, customers can check the status of their most recent orders by visiting the “My Orders” page in the “My Account” section. This is the easiest and fastest way to get the most up-to-date information regarding orders. When the customer clicks on the “Order Status” page, he will be asked to access with his email address and password. On the order summary page the customer will be informed in detail about their current and previous orders. Once the order has been sent, the corresponding tracking number will be shown, if available.
Occasionally, our system may cancel orders or parts of an order for various reasons: items not available, inability to process payment information, inability to deliver to the address provided, formulation of a duplicate order and / or cancellation at the request of a client. In this case, the client will receive an email explaining the reasons for the cancellation. Orders canceled will not be charged to the customer.

Returns & Exchanges
Given the nature of the products sold, all sales are final and returns are not accepted. The customer may request a product change by sending us at the electronic address indicated in the previous section, with the details of the relevant order, including the customer’s order code and the description of the products subject to the change. Changes in products opened and / or consumed in whole or in part will never be accepted.
Changes will only be accepted in the following cases:
- One or more products of the order have been damaged during the shipping and the container is totally or partially broken.
- One or more products of the order have an expiration date before the current date.
- One or more shipping products are wrong.
It will be an essential requirement for the change, that the client send a photographic evidence to the electronic address provided, within a maximum period of 24 hours from the receipt of the order (holidays and weekends included).
Order cancellations will only be approved if requested before the order enters preparation.
Applicable Legislation and Jurisdiction
These General Conditions of Use are governed by current Spanish legislation.
Pistamed and the client, expressly waiving any other jurisdiction that may correspond to them, submit to the Jurisdiction of the Courts and Tribunals of Alicante, for any questions that may arise or actions taken arising from the interpretation, validity and / or execution of these Terms and Conditions.
